These Terms & Conditions govern your use of our website, your purchase of products or services from Croft Retail LLC, and transactions completed online, in-store, by telephone, or through another method provided by us.

By accessing or using this website, submitting an order, or purchasing products or services from Croft Retail LLC, you acknowledge that you have read, understood, and agree to these Terms & Conditions.

ELIGIBILITY TO USE THIS WEBSITE

To use this website or purchase products or services from Croft Retail LLC, you must be at least 18 years old or the legal age of majority in your jurisdiction and possess the legal authority to enter into a binding agreement.

You may not use this website or our services where doing so would violate applicable law or regulation.

PRODUCT INFORMATION & OUR MATTRESSES

Foreverbed® and Croft mattresses are handcrafted in Webb City, Missouri using American-made manufacturing standards.

Because mattresses are handmade from flexible textile, foam, fiber, upholstery, spring, and other materials, minor variations in dimensions, stitching, quilting, tufting, fabric appearance, or finish are normal and are not considered defects unless they materially affect the mattress's intended function.

We make reasonable efforts to ensure that product descriptions, photographs, specifications, pricing, and other information displayed on this website are accurate. However, colors, textures, dimensions, appearance, and other characteristics may vary slightly from what is displayed on a screen or pictured online.

We reserve the right to correct typographical errors, pricing errors, product descriptions, availability information, or other inaccuracies at any time.

ONLINE PURCHASES

When purchasing an item through this website, you agree that:

1. You are responsible for reviewing the complete product listing, size, specifications, pricing, and applicable policies before completing your purchase.

2. You enter into a binding agreement to purchase an item when you submit your order and complete the checkout process.

3. You are responsible for verifying the accuracy of the products, sizes, quantities, delivery information, and other details contained in your order before submitting it.

All orders are subject to product availability and acceptance by Croft Retail LLC.

We reserve the right to decline or cancel an order when necessary because of product availability, pricing or listing errors, suspected fraud, payment issues, or other reasonable business circumstances. If we cancel an order after payment has been collected, the applicable payment will be refunded.

PRICING, PROMOTIONS & SALES TAX

Prices for our products and services are displayed on our website or provided at the time of purchase.

We reserve the right to change prices at any time and to correct pricing errors that may inadvertently occur.

Applicable sales tax and any delivery, shipping, assembly, customization, service, or other charges will be disclosed when applicable.

Promotions, discounts, coupons, store credits, financing promotions, free-product offers, and special pricing may be subject to separate eligibility requirements, expiration dates, product exclusions, minimum purchases, or other promotional terms.

Unless specifically stated otherwise, promotional offers have no cash value and may not be combined with other offers.

RETURNS, EXCHANGES & CANCELLATIONS

All mattress and adjustable base sales are final at the time of sale and may not be cancelled, returned, or exchanged.

Unopened pillows, sheets, bed frames, mattress protectors, and other eligible accessories may be returned within 30 daysfor store credit.

Delivery, shipping, assembly, and other service charges are nonrefundable.

The final-sale policy does not limit coverage for a qualifying manufacturing defect under an applicable warranty.

PICKUP & DELIVERY

Quoted fulfillment, pickup, and delivery dates are estimates and are not guaranteed.

Customers will be contacted to arrange a delivery window. Failure to be available during the scheduled delivery window may result in an additional delivery charge.

Customers must provide clear and safe access to the delivery area and remove existing mattresses, furniture, and other obstructions before the delivery crew arrives.

Standard delivery includes placement and basic assembly of purchased mattresses, foundations, and standard bed frames.

Adjustable bases, headboards, specialty beds, custom installations, or other products may require an additional fee.

Removal or disposal of existing mattresses, foundations, furniture, or household items is not included unless specifically agreed to in writing.

For customer pickup, Croft Retail LLC may assist with loading merchandise but does not secure merchandise to the customer's vehicle.

The customer is solely responsible for:

• Determining whether the vehicle is appropriate for transporting the merchandise.

• Properly securing the merchandise.

• Safe transportation after loading.

Croft Retail LLC is not responsible for damage occurring after merchandise has been loaded into the customer's vehicle.

BEDDING CARE & CUSTOMER EXPECTATIONS

New mattresses may require an adjustment period. We recommend sleeping on a new mattress for at least 30 days before evaluating its long-term comfort.

Some settling, softening, and body conformity are normal as comfort materials break in.

We recommend rotating the mattress head-to-foot monthly for the first three months and periodically thereafter, where the construction of the mattress permits rotation.

Mattresses must be used on an appropriate foundation, adjustable base, platform, or properly supported bed frame and maintained in a clean and sanitary condition.

Damage caused by inadequate support, misuse, abuse, improper handling, storage, contamination, infestation, excessive soiling, or unsanitary conditions is not covered by warranty.

PERFECT FIT GUARANTEE — FOREVERBED ONLY

The Perfect Fit Guarantee applies to Foreverbed-branded mattresses only and does not apply to Croft-branded mattresses.

Beginning on the 30th day of ownership and at any time thereafter while the original purchaser owns the mattress, the purchaser may receive one complimentary comfort modification if the purchaser needs the mattress adjusted softer or firmer.

Croft Retail LLC will determine the appropriate modification based on the mattress's construction, condition, and the customer's comfort needs.

The Perfect Fit Guarantee is a mattress modification program, not a return or exchange program.

The Perfect Fit Guarantee:

• Applies once to the original purchaser and original mattress.

• Is nontransferable.

• Does not provide a refund or mattress exchange.

• Does not include transportation, pickup, delivery, or shipping costs.

Transportation, pickup, delivery, and shipping related to a Perfect Fit modification are the purchaser's responsibility.

LIFETIME COMFORT SERVICE

After a Foreverbed purchaser has used the complimentary Perfect Fit modification, additional comfort modifications may remain available through Croft Retail LLC's Lifetime Comfort Service at the company's then-current material and labor charges.

Croft-branded mattresses are not eligible for the complimentary Perfect Fit Guarantee but may receive paid modifications through Lifetime Comfort Service when feasible.

Available work may include adding, removing, replacing, or modifying comfort materials and other components.

Specialty materials, internal-component changes, reconstruction, dimensional alterations, or other extensive modifications may cost more and are subject to technical feasibility and the condition of the mattress.

Lifetime Comfort Service is not a warranty and does not provide a right to:

• A refund.

• An exchange.

• A replacement mattress.

• Additional complimentary modifications.

Transportation, pickup, delivery, and shipping related to Lifetime Comfort Service are the purchaser's responsibility.

Lifetime Comfort Service applies only to the original purchaser and original mattress and is nontransferable.

MATTRESS LIMITED WARRANTIES

Foreverbed Mattresses

Foreverbed-branded mattresses are warranted to the original retail purchaser for as long as the purchaser owns the mattress, subject to the terms, limitations, and exclusions contained in this section.

Croft Mattresses

Croft-branded mattresses carry a 10-year, non-prorated limited warranty to the original retail purchaser.

Both warranties cover qualifying defects in materials and workmanship occurring during normal residential use.

Examples of Covered Defects

Covered defects may include:

• Defective internal components.

• Permanent body impressions exceeding 1½ inches, measured without weight applied and while the mattress is properly supported.

• Abnormal cracking, splitting, or separation of foam caused by a manufacturing defect.

• Component delamination.

• Defects in stitching or construction that materially impair normal use.

Items Not Covered

The warranty does not cover:

• Normal softening or changes in comfort.

• Body conformity or impressions measuring 1½ inches or less.

• Changes in personal comfort preference.

• Normal wear.

• Cosmetic variations.

• Inadequate or improper support.

• Misuse or abuse.

• Improper handling.

• Improper storage.

• Bending, folding, or improper transportation.

• Burns, cuts, tears, or punctures.

• Liquid damage.

• Contamination.

• Infestation.

• Excessive soiling.

• Unsanitary conditions.

• Damage resulting from circumstances unrelated to a manufacturing defect.

WARRANTY REMEDY

For a confirmed covered defect, Croft Retail LLC will repair the mattress as reasonably necessary to correct the covered defect.

Unless otherwise required by applicable law, the written warranty does not provide a right to a refund, exchange, or replacement mattress.

Transportation, pickup, delivery, and shipping associated with warranty service are the purchaser's responsibility.

Warranty coverage applies only to the original retail purchaser, is nontransferable, and requires proof of purchase.

WARRANTY CLAIMS

Customers requesting warranty service may be required to provide reasonable documentation allowing Croft Retail LLC to evaluate the claim. This may include:

• Proof of purchase.

• Photographs or video of the mattress.

• Photographs showing measurements of any claimed body impression.

• Photographs of the mattress foundation, adjustable base, platform, or supporting bed frame.

• Additional information reasonably necessary to determine whether a covered defect exists.

Croft Retail LLC may require inspection of the mattress before approving warranty service.

STORE CREDITS & PROMOTIONAL CREDITS

Any store credit, promotional credit, merchandise credit, or similar benefit issued by Croft Retail LLC is subject to the terms of the particular promotion or transaction through which it was issued.

Unless expressly stated otherwise:

• Store credits are not redeemable for cash.

• Store credits may not be sold or transferred.

• Promotional credits apply only to eligible merchandise.

• Credits may not be applied retroactively to previous purchases.

• Promotional credits may not be combined with another promotion when specifically excluded by the terms of the offer.

FINANCING

Financing may be provided by independent third-party financing companies and is subject to credit approval and the lender's terms and conditions.

Croft Retail LLC does not determine credit approval, interest rates, financing limits, or other lending decisions.

Any financing examples or estimated monthly payments displayed on this website are for informational purposes and may vary based on purchase amount, financing provider, creditworthiness, selected promotional program, taxes, fees, and other factors.

WEBSITE AVAILABILITY

We may, without prior notice:

• Modify the website or services.

• Add or remove products or features.

• Limit access to certain services.

• Temporarily suspend website functionality.

• Permanently discontinue services or features.

We do not guarantee that the website will be available without interruption or error at all times.

INTELLECTUAL PROPERTY

The website and materials contained on or made available through it, including without limitation software, designs, images, text, graphics, logos, trademarks, service marks, photographs, audio, video, product designs, written content, and other intellectual property, are owned by Croft Retail LLC or used with permission from their respective owners.

Except as expressly authorized, nothing in these Terms grants a license or right to sell, license, rent, modify, distribute, reproduce, transmit, publicly display, publish, adapt, edit, or create derivative works from Croft Retail LLC intellectual property.

USER-SUBMITTED CONTENT

If you upload, submit, transmit, or otherwise provide photographs, reviews, comments, designs, images, videos, or other content through our website or services, you represent that you own the applicable rights to that content or have permission to provide it.

Where content is intentionally submitted for public display, such as a review or testimonial, you authorize Croft Retail LLC to display that content in connection with our website and business, subject to applicable law.

ELECTRONIC COMMUNICATIONS & MARKETING

By providing an email address, telephone number, or other contact information in connection with an order, inquiry, fitting request, warranty request, or other transaction, you authorize Croft Retail LLC to contact you as reasonably necessary to respond to your request, service your account, fulfill your order, arrange delivery, address warranty or service matters, or otherwise complete the transaction.

Promotional email or text communications will be sent subject to applicable law and any consent requirements that apply.

You may opt out of promotional communications using the unsubscribe instructions provided with the communication or by contacting us.

Opting out of promotional communications does not prevent us from sending transactional or service-related communications concerning an existing purchase, delivery, appointment, warranty matter, or other customer request.

THIRD-PARTY SERVICES & LINKS

Our website may use or provide links to services operated by third parties, including payment processors, financing providers, scheduling systems, social-media platforms, mapping services, and other websites.

Croft Retail LLC does not control third-party websites or services and is not responsible for their separate content, privacy practices, availability, or terms.

Your use of a third-party service may be governed by that provider's own terms and privacy policy.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Croft Retail LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of this website or inability to use the website.

Croft Retail LLC assumes no responsibility for unauthorized access to systems or information caused by circumstances outside its reasonable control, except to the extent responsibility cannot legally be excluded.

Nothing in these Terms is intended to waive, restrict, or exclude any right or remedy that cannot legally be waived, restricted, or excluded under applicable law.

INDEMNIFICATION

CHANGES TO THESE TERMS

Croft Retail LLC reserves the right to modify these Terms & Conditions from time to time.

Your continued use of the website after revised Terms are posted constitutes acceptance of the revised Terms with respect to subsequent website use.

Terms governing an existing retail transaction will be determined by the terms applicable to that transaction at the time of purchase unless otherwise required by law.

GOVERNING LAW & VENUE

These Terms and any dispute arising from them will be governed by the laws of the State of Missouri, without regard to its conflict-of-law principles, except where federal or other applicable law controls.

To the extent legally permitted, claims or disputes arising from these Terms or services provided by Croft Retail LLC will be brought in a court of competent jurisdiction in Missouri.

Nothing in this provision limits any consumer right that cannot legally be waived or restricted.

SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

CUSTOMER ACKNOWLEDGMENT FOR PURCHASES

By completing a purchase, the customer acknowledges that they have reviewed their order for accuracy and have read and understand the applicable terms, including:

• The final-sale policy for mattresses and adjustable bases.

• Pickup and delivery terms.

• Bedding-care requirements.

• The Foreverbed Perfect Fit Guarantee.

• Lifetime Comfort Service.

• The applicable mattress Limited Warranty.
